Court of Appeal Rejects NAM1’s Bid to Suspend Criminal Trial in Menzgold Case

The Court of Appeal has dismissed an attempt by Nana Appiah Mensah, also known as NAM1, to halt criminal proceedings against him, marking a major turning point in the ongoing Menzgold story. The application was filed by NAM1, the troubled CEO of the now-defunct Menzgold Ghana Limited, while he awaited the outcome of an appeal against a High Court ruling that required him to present his defense.

A number of charges against him, including money laundering, operating a gold trading business without a license, fraudulent breach of trust, and deceiving by false pretense, are the basis for the criminal prosecution. The High Court mandated in 2024 that NAM1 start defending himself against these grave accusations.

NAM1’s legal team refused to follow the decision and appealed the High Court’s decision in the Court of Appeal. They also filed a request to halt the current trial until the outcome of the appeal was known. However, state prosecutors fiercely contested the motion at proceedings on Monday, May 19, 2025.

They contended that since the motion did not provide any extraordinary legal justification for stopping the trial, it was a ruse to postpone it and had no merit. The application was unanimously denied by a three-member Court of Appeal bench led by Justice Gbiel Suurbaareh and backed by Justices Afia Serwaa Asare-Botwe and Christopher Archer. The panel underlined that there were no strong grounds for overriding the High Court’s order.

Frederick Forson, a representative for the irate Menzgold clients, responded to the decision by hailing it as a positive step toward bringing justice to the hundreds of people who lost their money in the defunct gold store. Despite the defeat, NAM1 has indicated that, on the counsel of his attorneys, he may seek additional legal remedy by taking the case all the way to the Supreme Court.
