Supreme Court to Hear Challenge Against Anti-Gay Bill on July 3, 2024

The Supreme Court of Ghana has scheduled a hearing for July 3, 2024, regarding the legal challenge brought by private legal practitioner Richard Dela Sky against the controversial Human Sexual Rights and Family Values Bill, commonly known as the anti-gay bill.

Sky is contesting the constitutionality of the bill, arguing that its passage violates Ghana’s laws and fundamental human rights.

He seeks a declaration from the court that the bill is null and void.

Initially, the case was adjourned to May 17, 2024, to allow Sky to file an updated motion with a supporting affidavit and a detailed statement outlining his legal arguments. This was to provide a clearer basis for his challenge against the bill.

In a notice issued on June 14, 2024, and signed by Registrar Hellen Ofei-Ayeh, the Supreme Court emphasized the importance of the scheduled hearing.

The notice warned that the court would proceed with the hearing on July 3, 2024, at 9:30 am, regardless of the presence of representatives from the parties involved.

The notice stated: 

“TAKE NOTICE THAT the above-mentioned case has been fixed for WEDNESDAY THE 3RD DAY OF JULY, 2024 at 9:30 am for hearing. If the case is called and you do not appear to answer, the Court will proceed to hear same without you.”

This directive underscores the court’s intent to move forward with the case, emphasizing the importance of timely representation and the potential consequences of non-attendance.

The Human Sexual Rights and Family Values Bill has been a subject of significant debate in Ghana, attracting both national and international attention due to its implications for human rights and freedoms.
